Terms and Conditions for On Tap Anywhere Mobile Bar Service
- Acceptance of Terms By booking a mobile bar service with the owners of the mobile bar unit, its domain owners' and subsidiaries (“On Tap Anywhere also known as ontapanywhere.com”), you ("Customer") agree to comply with and be bound by these Terms and Conditions. Please read these terms carefully before proceeding with your booking.

Service Description On Tap Anywhere provides a mobile bar service that delivers kegs of beer and sets up the bar for private events in North Carolina. Our service includes a licensed bartender for a nominal fee (if unobtainable or requested by the Customer), setting up the designated bar area (6 ft. radius surrounding mobile tap bar) and providing beer delivery as agreed in the booking details.
- Booking and Payment
- Booking Confirmation: All bookings are subject to availability and will only be confirmed upon receipt of the deposit.
- Deposit: A non-refundable deposit of 20% of the total service fee is required to secure your booking.
- Final Payment: The remaining balance must be paid in full no later than 10 days before the event.
- Cancellation Policy: Cancellations made less than 10 days before the event will incur a 20% cancellation fee. Deposits are non-refundable.
- Alcohol Service Compliance
- On Tap Anywhere complies with North Carolina Alcoholic Beverage Control (ABC) regulations. By booking our service, you agree that all individuals consuming alcohol will be 21 years of age or older. Proof of age may be required.
- Alcohol will only be served by our licensed staff and only to guests with proper identification.
- Keg Transportation Permit: In accordance with North Carolina ABC laws, a keg transportation permit may be required for the delivery of kegs to your event location. On Tap Anywhere will assist with the necessary documentation, but it is the Customer’s responsibility to obtain and hold a valid keg transportation permit, as needed, before the event date. Failure to provide a valid permit may result in cancellation of the service, with no refund of the deposit.
- Customer Responsibilities
- Permits and Licenses: The Customer is responsible for obtaining any necessary permits or licenses to host an event with alcohol service at the chosen venue.
- Venue Restrictions: The Customer is responsible for ensuring that the event venue permits alcohol service by a third-party provider and has the necessary facilities to support our mobile bar setup.
- Safety and Conduct: The Customer is responsible for maintaining a safe and respectful environment for all attendees. On Tap Anywhere is not liable for accidents or incidents arising from guests' inappropriate behavior.
- Liability and Insurance
- On Tap Anywhere carries general liability insurance per event, but the Customer is advised to carry additional event insurance for full coverage.
- On Tap Anywhere is not liable for any damage, injury, or loss incurred during the event due to factors beyond our control, including but not limited to guests' behavior, property restrictions, or force majeure events.
- Damages and Cleanup
- The Customer is responsible for any damage to On Tap Anywhere's equipment caused by guests or event staff.
- On Tap Anywhere will handle the bar area setup and cleanup. However, we are not responsible for cleanup outside of the designated bar area unless otherwise agreed upon.
- Indemnification The Customer agrees to indemnify and hold harmless On Tap Anywhere and its employees from any claims, damages, losses, or expenses, including reasonable attorney fees, arising out of or resulting from the service provided, except where caused by On Tap Anywhere negligence.
- Governing Law: These Terms and Conditions are governed by the laws of the state of North Carolina. Any legal actions related to this agreement shall be filed in the appropriate state or federal courts within North Carolina.
- Modifications On Tap Anywhere reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Customer prior to their booking confirmation.

Arbitration Agreement Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the services provided by On Tap Anywhere shall be resolved through binding arbitration, rather than in court, except that either party may bring claims in small claims court if the claims qualify. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), and judgment on the arbitration award may be entered in any court having jurisdiction.

Governing Law: This arbitration agreement is governed by the laws of the state of North Carolina.

Location: The arbitration shall take place in Charlotte, NC, unless both parties agree to a different location.

Costs: Each party shall bear its own costs associated with the arbitration, except that On Tap Anywhere will be responsible for the AAA's administrative fees.

Waiver of Jury Trial: Both parties waive their constitutional and statutory rights to go to court and have a trial in front of a judge or jury. Instead, disputes will be resolved by a neutral arbitrator.

Class Action Waiver: All claims must be brought in the parties' individual capacities, and not as a plaintiff or class member in any purported class or representative proceeding.

By agreeing to these Terms and Conditions, you acknowledge and agree to resolve any disputes through binding arbitration as outlined in this section.
